Terms of Service

1. Acceptance of Terms

By accessing or using devto (“the Service”), including the web dashboard at devto.ai and the devto-mcp CLI package, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and devto.

2. Description of Service

devto is an AI work management tool that operates inside Claude Code via MCP (Model Context Protocol). The Service enables developers to plan features, create structured work items, and manage project workflows from within their terminal. Work items are synchronized to third-party project management tools (including Jira, with support for Linear and GitHub Issues planned) configured by the user.

3. Eligibility

You must be at least 16 years old to use the Service. By using devto, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You are responsible for all activity that occurs under your account.

5. Acceptable Use

You agree not to:

• —Use the Service for any unlawful purpose or in violation of any applicable laws
• —Attempt to gain unauthorized access to other users’ accounts, data, or workspaces
• —Circumvent usage limits, rate limits, or billing mechanisms
• —Create multiple free-tier accounts to avoid payment
• —Reverse-engineer, decompile, or disassemble the Service
• —Use the Service to generate spam, abusive content, or for any activity that violates the rights of others
• —Interfere with or disrupt the Service or servers or networks connected to the Service
• —Use automated systems (bots, scrapers) to access the Service except through our published API
• —Sublicense, resell, or redistribute the Service to third parties

6. Plans and Billing

The Service is offered in three tiers:

• —Free plan: Limited to 1 developer, 1 project, and 75 actions per calendar month. No credit card required. devto branding appears on created tickets.
• —Pro plan ($25/seat/month): Includes a 14-day free trial. Credit card required at signup. You will not be charged until day 15. Unlimited projects and actions. No devto branding on tickets. You may cancel at any time.
• —Team plan ($20/seat/month): Billed monthly per seat. Minimum of 5 seats required. No trial period. Shared workspace connection across team members.

All payments are processed by Stripe. Prices are in USD and exclude applicable taxes. You authorize us to charge your payment method on a recurring basis. Refunds are handled on a case-by-case basis within 30 days of charge. Cancellations take effect at the end of the current billing period — you retain access until then.

7. Free Trial

The Pro plan includes a 14-day free trial. During the trial, you have full access to Pro features. If you do not cancel before the trial ends, your payment method will be charged automatically. You may cancel at any time during the trial without being charged.

8. API Keys and Security

You are responsible for the security of your devto API keys. Keys should not be shared, committed to version control, or exposed in client-side code. If you believe a key has been compromised, revoke it immediately through the dashboard and generate a new one. We are not responsible for unauthorized access resulting from compromised API keys.

9. Third-Party Integrations

The Service integrates with third-party tools including Jira (Atlassian), Linear, GitHub, and Anthropic. Your use of these integrations is subject to their respective terms of service. devto is not affiliated with Atlassian, Linear, GitHub, or Anthropic. We are not responsible for the availability, accuracy, or performance of third-party services. You are responsible for ensuring your use of devto with these integrations complies with their terms.

10. Intellectual Property

You retain all rights to your content, including feature descriptions, plans, and project data submitted through the Service. devto retains ownership of the Service, including its software, design, documentation, and trademarks.

The devto-mcp package is distributed under its published license terms. Nothing in these Terms grants you rights to devto’s trademarks, logos, or branding except as expressly permitted.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We will make reasonable efforts to notify users of planned maintenance. We are not liable for any loss or damage resulting from service downtime.

12. Limitation of Liability

To the maximum extent permitted by applicable law, devto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated plans and suggestions are provided as a convenience and should be reviewed by a qualified person before execution. We do not warrant that the Service will meet your specific requirements or that results obtained from the Service will be accurate or reliable.

14. Indemnification

You agree to indemnify, defend, and hold harmless devto and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

15. Termination

You may terminate your account at any time through the dashboard settings. Upon termination:

• —Your access to the Service will be revoked immediately
• —All associated data will be permanently deleted in accordance with our Privacy Policy
• —Any active subscription will be cancelled (no refund for the current billing period)

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay applicable fees. We will provide notice before termination where practicable.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance. If you disagree with the changes, you should discontinue use and delete your account before the changes take effect.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the state or federal courts located in Delaware. You agree to submit to the personal jurisdiction of these courts.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and devto regarding the Service and supersede all prior agreements and understandings.
